Key Form Details
JDF 1115 — Separation Agreement
The Separation Agreement is the complete written agreement between the parties. It must address:
- All real property: address, legal description, which spouse receives it, equity division, refinancing deadline, deed transfer instruction
- All bank and investment accounts: institution, account identifier, who receives which
- All retirement accounts: plan name, account type, division method (QDRO or IRA transfer), formula
- All vehicles: description, who keeps, loan balance, refinancing
- All debts: which spouse is responsible; indemnification language
- Maintenance: amount, start date, duration, termination events — or explicit mutual waiver
- Personal property: general assignment or itemized list
Both spouses sign JDF 1115 before a notary.
JDF 1113 — Parenting Plan
The Parenting Plan addresses:
- Primary residential parent (parent with majority of parenting time)
- Parenting time schedule: school year, summers, holidays
- Decision-making: joint or designated for major decisions (education, medical, religious)
- Exchange logistics
- Dispute resolution process
JDF 1100A — Waiver of ISC (Initial Status Conference)
Filing this form (or equivalent local court form) requests the cancellation of the ISC for agreed cases. Usually requires all paperwork to be complete and submitted simultaneously.
Initial Status Conference (ISC) — What to Know
Every Colorado dissolution has an ISC automatically scheduled. Purpose: brief procedural check-in with a magistrate or judge.
For agreed cases:
- File complete Separation Agreement and all final papers simultaneously with ISC waiver
- Court reviews and cancels the ISC
- No appearance required
If ISC is held (not waived):
- Typically 15–30 minutes
- Magistrate confirms case status
- For agreed cases, often ends with a hearing date for the Decree
Post-Dissolution: Deed Recording
Colorado counties use the county Clerk and Recorder's office for deed recording.
After the Decree:
- Prepare a new deed (Quitclaim Deed for dissolution transfers)
- The leaving spouse signs and notarizes
- Record at the county Clerk and Recorder
- Fee: approximately $13–$30 per document
